Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Genbox platform at genbox.dev and related services (collectively, the "Service"), operated by RupeeStack Platform Private Limited, a company incorporated under the laws of India ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Use the Service to distribute malware, conduct attacks, or engage in any activity that harms or disrupts the Service or other users.
• Resell, sublicense, or redistribute the Service without our prior written consent.
• Use the provisioned cloud environments for cryptocurrency mining, denial-of-service attacks, or any purpose unrelated to software development.
• Circumvent any usage limits, credit systems, or access controls.

5. Credits and Payments

The Service operates on a credit-based billing system. Credits are consumed based on usage of cloud development environments. Credits are non-refundable unless required by applicable law. We reserve the right to modify pricing and credit rates with reasonable notice. Environments may be automatically destroyed when credits are exhausted to prevent unauthorized charges.

6. Intellectual Property

The Service, including its software, design, logos, and documentation, is the intellectual property of RupeeStack Platform Private Limited and is protected by applicable intellectual property laws. You retain ownership of all code and content you create using the Service. We do not claim any rights over your code, repositories, or development outputs. Your use of the Service grants you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

7. Third-Party Services

The Service integrates with third-party providers including cloud infrastructure providers, AI tools, and Git hosting services. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RUPEESTACK PLATFORM PRIVATE LIMITED AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless RupeeStack Platform Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. All active development environments will be destroyed. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India. You irrevocably consent to the jurisdiction and venue of such courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
